Texas man dead in collision on Highway 349

One man was killed and another was injured in an accident that took place shortly before 6 a.m. on July 23 on Highway 349 near Midland. Police said that a 24-year-old man driving a Chevrolet Silverado southbound on the highway lost control of his vehicle after the left front tire blew out. This caused him to veer into the northbound lane where he collided with a Ford F-150 pickup driven by a 25-year-old man.

The collision caused the Ford to go into a bar ditch, flip over and partially eject the driver. The man driving the Silverado was taken to Midland Memorial Hospital for treatment, and the driver in the F-150 was pronounced dead around 7:50 a.m. There was no word as to the extent of the injuries suffered by the driver in the Silverado, and police said that both men were wearing seat belts at the time of the accident.

If a driver is hurt or killed in a motor vehicle wreck, that person or the family of a decedent may be able to pursue a civil lawsuit against the at-fault motorist. At trial or in a pretrial settlement, it may be possible to win compensation for medical bills, final expenses or punitive damages in some cases.

A personal injury attorney may be able to use maintenance records as evidence to potentially prove that the driver knew or should have known that there may have been an issue with his or her car and did nothing about it. This could prove negligence on the part of the driver, for instance.
